License Agreement

This License Agreement (“Agreement”) is a legal agreement between you (“User,” “you,” or “your”) and theblanck (“we,” “us,” or “our”) governing your use of gradients, assets, and exports created using the Shader Gradient tool (“Tool”) accessible at huegrid.app.

By accessing or using the Tool, you acknowledge that you have read, understood, and agree to be bound by the terms of this Agreement. If you do not agree to these terms, you must not use the Tool or any assets generated through it.

The Tool offers two tiers of access, each with distinct licensing terms:

Subject to the terms and conditions of this Agreement, theblanck grants you a non-exclusive, non-transferable, worldwide license to use, reproduce, and display the gradient assets and exports generated through the Tool (“Licensed Assets”) in accordance with your subscription tier.

This license is granted solely to you and may not be assigned, sublicensed, or transferred to any third party without prior written consent from theblanck. The license applies to the final exported assets only and does not extend to the Tool itself, its source code, algorithms, or underlying technology.

Under the applicable tier, you may use Licensed Assets in the following ways:

• Personal projects, portfolios, and social media content
• Commercial projects including websites, applications, marketing materials, and print collateral (Pro tier only)
• Client work and deliverables as part of a larger design or product (Pro tier only)
• Modifications including cropping, overlaying, color-adjusting, combining with other elements, and incorporating into composite works
• Digital and physical products where the gradient is a component of a larger work, not the primary product itself

Regardless of your subscription tier, the following restrictions apply:

• You may not resell, redistribute, or sublicense raw gradient exports as standalone digital assets, stock graphics, or asset packs.
• You may not redistribute, share, or make publicly available any of the Tool's presets, templates, or preset configurations.
• You may not sublicense, transfer, or assign any rights granted under this Agreement to third parties.
• You may not use Licensed Assets in competing gradient generation tools, services, or platforms.
• You may not claim ownership of or seek to patent the Tool's underlying technology, algorithms, or shader code.

theblanck retains all rights, title, and interest in and to the Shader Gradient Tool, including but not limited to its source code, shader algorithms, user interface design, presets, templates, and any proprietary technology embodied therein. Nothing in this Agreement conveys any ownership interest in the Tool to you.

You retain ownership of your custom gradient configurations, including your unique combinations of parameters, color selections, and settings. You also own the final exported works that you create using the Tool, subject to the restrictions set forth in this Agreement.

theblanck reserves the right to feature or showcase gradients created with the Tool in marketing materials, galleries, or promotional content, unless you explicitly opt out through the Tool's settings.

This Agreement is effective until terminated. theblanck may terminate this Agreement immediately and without notice if you breach any of its terms. Upon termination, you must cease all use of the Tool and delete any Licensed Assets obtained in violation of this Agreement.

Upon cancellation of a Pro subscription, your access to Pro features will revert to the free tier. However, any Licensed Assets that were lawfully exported during your active Pro subscription period remain licensed under the terms that applied at the time of export. You are not required to remove or stop using previously exported Pro assets.

theblanck reserves the right to suspend or discontinue the Tool, or any part thereof, at any time with reasonable notice. Such discontinuation does not affect the license granted for previously exported assets.

THE TOOL AND ALL LICENSED ASSETS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THEBLANCK DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.

theblanck does not warrant that the Tool will be uninterrupted, error-free, or free of harmful components. theblanck does not warrant that exported assets will meet your specific requirements or achieve any particular results. Your use of the Tool and any Licensed Assets is at your sole risk.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THEBLANCK, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE TOOL OR LICENSED ASSETS.

THEBLANCK'S TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATED TO THIS AGREEMENT SHALL NOT EXCEED THE TOTAL AMOUNT OF SUBSCRIPTION FEES PAID BY YOU TO THEBLANCK IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM. IF YOU HAVE NOT PAID ANY FEES, THEBLANCK'S TOTAL LIABILITY SHALL NOT EXCEED FIFTY UNITED STATES DOLLARS (USD $50.00).

Entire Agreement. This Agreement constitutes the entire agreement between you and theblanck with respect to the subject matter hereof and supersedes all prior or contemporaneous communications, representations, or agreements, whether oral or written.

Amendments. theblanck reserves the right to modify this Agreement at any time. Material changes will be communicated through the Tool or via email. Your continued use of the Tool following such modifications constitutes your acceptance of the revised terms.

Severability. If any provision of this Agreement is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that this Agreement shall otherwise remain in full force and effect.

Governing Law. This Agreement shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles.
